On the basis of the instruction of the Commissioner for Human Rights (Ombudsman) Elmira Suleymanova, members of the National Preventive Group (NPG) carried out the next visit to Detention Center of Administratively Arrested Persons under the Ministry of Internal Affairs without prior notice.
The visit, organized on the basis of the OPCAT and the Constitutional Law on the Ombudsman, was aimed at investigation of conditions of detention and treatment issues, received applications; monitoring the status of ensuring the rights of detainees, documentation in the facility.
The members of the NPG investigated the detention conditions, arrangement of medical assistance, nutrition, also the status of ensuring the rights of detainees regarding meeting, phone calls, reception of parcels, walking and the documentation.
During the visit attended by the physician-member as well, the NPG received and heard a number of detained persons, including Tofig Yagublu, in a confidential manner in order to investigate the treatment issues; their appeals were received. The state of ensuring the rights of detainees, raised issues, documentation were monitored; a range of appeals, including the application of T. Yagublu with regard to meeting with a family member and the conditions of detention were ensured.
At the end, awareness raising discussions were held with the administration and staff of the facility on the basis of the national and international legislation, and relevant recommendations were made.
The outcome of the visit and the raised issues were addressed to the relevant state bodies.
