Commissioner's mandate

Our Mandate

The office of the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan (hereinafter referred to as the Commissioner) is established in the Constitution of the Republic of Azerbaijan and in international agreements to which the Republic of Azerbaijan is a party, and is the responsibility of state bodies, municipalities of the Republic of Azerbaijan, as well as the control of shares (shares) owned by the state or municipality. restoration of human rights and freedoms violated by legal entities (including public legal entities) and budget organizations (hereinafter – state bodies, municipalities and other institutions) belonging to the surrounding state or municipality, their officials and established by this Constitutional Law was established to prevent human rights violations.

The Commissioner performs the functions of the national preventive mechanism provided for in the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. In order to prevent torture and other cruel, inhuman or degrading treatment or punishment, he shall visit places where detainees are unable to leave of their own volition on a regular basis or whenever he deems necessary.

The supervision of authorized state bodies, municipalities, public legal entities, and their officials (hereinafter, information owners) to fulfill the duties arising from the requirements of the Law of the Republic of Azerbaijan "On Access to Information", as well as the Convention on the Rights of Persons with Disabilities (CRPD) and the Convention on the Rights of the Child (CRC) performs the functions of an independent monitoring mechanism for monitoring and promoting the implementation of the Convention, ensuring the right to equality, and preventing discrimination.

In accordance with the directions of activity, the Commissioner may cooperate with local, regional and international organizations, as well as with human rights institutions in foreign countries, conclude contracts for this purpose, and be represented in international institutions.

The activity of the Commissioner does not limit or replace the powers of other state bodies that ensure the protection of human rights and the restoration of violated human rights and freedoms. Besides, checking the activities of the President of the Republic of Azerbaijan, deputies of the Milli Majlis of the Republic of Azerbaijan and judges of the Republic of Azerbaijan does not belong to the powers of the Commissioner.

The Commissioner may make proposals to the President of the Republic of Azerbaijan regarding the resolution of the issues of amnesty, citizenship, and political asylum, as well as to the Milli Majlis of the Republic of Azerbaijan on the adoption, cancellation, or changes to laws for the purpose of ensuring human rights and freedoms.

The Commissioner has the right to consider complaints about human rights violations related to procrastination in courts, lost and untimely delivery of documents, as well as delays in the execution of court decisions.

The Commissioner, who bases his activities on the principles of openness, transparency, legality, justice, and impartiality, can conduct an analysis of the implementation process of state programs, strategies, national action plans, and concepts in the field of human rights, and submit his opinions and proposals to the institution that performs monitoring and evaluation in the relevant field.

The activities of the Commissioner in the field of human rights protection include the protection of human and civil rights and freedoms, their observance, study, monitoring and analysis of the state of provision, as well as the detection of deficiencies and violations, the restoration of violated rights, and the prevention of violations.
