The Temporary Detention Facility of the Main Department for Preliminary Investigation of Tax Crimes under the State Tax Service was monitored

Within the national preventive mandate of the Human Rights Commissioner (Ombudsman) of Azerbaijan, the Ombudsman’s National Preventive Group members conducted a monitoring of the Temporary Detention Facility (TDP) of the Main Department for Preliminary Investigation of Tax Crimes under the State Tax Service without prior notice.  

The objective of the monitoring, which is organized in conformity with the provisions of the UN OPCAT, the Constitutional Law on the Ombudsman of Azerbaijan, and the Law on Ensuring the Rights and Freedoms of Persons Held in Detention Places, is to inspect conditions of detention and treatment issues, as well as the general situation of the implementation of the rights of detainees in this facility.  

In the course of the monitoring, all facilities, such as detention cells, an interrogation room, a medical room, a prayer room, a kitchen, and a walking area were inspected. In addition, people confined in the TDP were interviewed in a confidential manner. 

The legal-awareness talks were held for the management and staff of the facility, providing them with recommendations for the improvement of detention conditions and documentation in accordance with the relevant legislation. They were extensively informed about the Ombudsman’s NPM mandate and competences and provided with a flyer with information about the 24-hour “916” Call Center, booklets, and other publications.
