National Preventive Group conducted visits to Temporary Detention Center and police stations

The next planned visit by the National Preventive Group (NPG )upon the order of the Ombudsman was conducted to the Temporary Detention Center (TDP) of the Ministry of Internal Affairs Yasamal District Police Department and the police stations No. 29, 26, 28 of the same department without prior notification.

The aim of the visit organized on the basis of the requirements of the Optional Protocol to the United Nations Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment and the Constitutional Law on the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan was to investigate the detention conditions and treatment issues, the situation with documentation.

Within the visit documents proving the legality of detention, as well as the documents regarding treatment and detention conditions of the detainees’ were investigated, all the cells were monitored, the documentation on nutrition, medical assistance, walking, meeting, phone conversations, leaving the cells and regarding parcels  was checked, current needs were studied.

NPG members interviewed the persons detained in the TDP, arrested on the basis of criminal-procedural legislation, responded their applications, explained them their rights and the competences of the Ombudsman and provided them legal advice.

Within the framework of the visits to those departments and stations, investigation rooms were reviewed; relevant registration journals and documentation were studied. Outcome of the visit was discussed with the administration of District Police Department, as well as improving the status of documentation and provision of appeals and legal awareness discussions were held with the responsible staff members and recommendations in accordance with the national and international legislation were given.
