Upon the instruction of the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan Elmira Suleymanova, the next visit by the National Preventive Group (NPG) members was conducted to the Temporary Detention Place (TDP) of the Main Department of Combating Organized Crime under the Ministry of Internal Affairs of the Republic of Azerbaijan.
The purpose of the visit organized on the basis of the requirements of Optional Protocol to the United Nations Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT) and the Constitutional Law on the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan, was to investigate the detention conditions and treatment issues in the facility, learning the status of ensuring the rights of persons detained in accordance with the legislation and the adequate documentation.
At the time of the visit, there have been no detainees in the TDP. Thus the documents regarding previously detained persons were investigated, the cells were reviewed and the documentation on nutrition, medical assistance, walking, meeting, phone conversations, removing from the cell, parcels was monitored.
At the end, awareness-raising discussions were held with the staff members of the TDP on the basis of the provisions of the OPCAT, the Constitutional Law on the Commissioner (Ombudsman) of the Republic of Azerbaijan and the Internal Rules of Discipline of the TDPs, the relevant recommendations in accordance with the national and international legislation were given. The issues of improvement of the activity on implementing documentation and ensuring appeals were discussed.
