The NPG conducted planned visit to Temporary Detention Place of the Nasimi District Police Department as well as to the police stations No. 19, 20, 21, and 22 of the same DPD without prior notice.
The purpose of the visit based on the requirements of OPCAT and Constitutional Law on Ombudsman was to investigate detention condition and treatment, ensuring the rights of detainees and documentation.
The Group members inspected the documents confirming the lawfulness of detention, treatment; NPG monitored all cells in the police facility and checked the quality of and access to nutrition, meeting and medical care service, phone calls, parcels, walking, as well as documentation regarding cell extractions. The basic needs of detainees have been learned.
The Group members held private talks with administratively detained as well as detained and arrested persons who are accused of (pending) criminal charges. The interviewed complained about the investigation of their criminal cases and the group members legally consulted them with regard to the issues of decriminalization, criminal and civil law questions.
At the end of the visit, issues dealing with the documentation, custody condition, ensuring the appeals have been discussed with the administration of the TDP facility and Group members held awareness work with the staff and put forward recommendations.
There was no detainee during the visits to police stations No. 19, 20, 21 and 22 of the Nasimi Police Department. The NPG held awareness talks with responsible staff and gave appropriate recommendations in line with the Constitutional Law on Ombudsman and OPCAT, to eliminate inadequacies and to improve of the documentation process.
The outcome of the monitoring will be submitted to the Ministry of Interior.
