
The conditions of detention, the situation of ensuring the rights of detained persons are monitored and inspected during on-site investigations under the NPM mandate of the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan.
During another visit, the Ombudsman Sabina Aliyeva received in a confidential manner A.G. from Armenia, identified and apprehended in the liberated territory of Azerbaijan.
During the conversation, the Ombudsman listened to the requests of the detainee, presented him the relevant legislative acts in his language and explained his rights.
It was observed that international legal norms, particularly the provisions of the Geneva Conventions, were upheld in relation to the individual without any discrimination, ensuring the protection of their rights as well as access to necessary medical and psychological services.
The individual expressed satisfaction with the conditions of detention, treatment, nutrition, and medical care, and also conveyed gratitude to the Azerbaijani state for the provided treatment.
Within the framework of a visit conducted in accordance with the requirements of the OPCAT, as well as the Constitutional Law on the Ombudsman of the Republic of Azerbaijan, it was observed that, in addition to the detention conditions, the rights of the detainee were ensured in line with international legal norms. The visit was carried out with the participation of a medical doctor member of the Ombudsman’s National Preventive Group. The detainee thanked the Ombudsman Sabina Aliyeva for the meeting.
It should be noted that Armenia has seriously violated IHL, particularly the provisions of the 1949 Geneva Conventions, in its treatment of non-combatants, hors de combats, and Azerbaijani hostages. They were denied initial and essential medical assistance, deprived of food, and subjected to torture and inhumane treatment.
