Under the instructions of the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan, Sabina Aliyeva, and within the framework of the activities of the Working Group on ‘Mental Health and Human Rights’ at the Ombudsman Office, staff of the Ombudsman Office carried out a monitoring visit to the ‘Gurtulush’ Rehabilitation Center, which provides rehabilitation services for various types of addictions.
The objective of the monitoring, organized on the basis of the Constitutional Law on the Ombudsman, and the Laws of the Republic of Azerbaijan ‘On Psychiatric Assistance’ and ‘On Narcological Service and Control’, was to examine the conditions of detention and treatment issues at the center, as well as assess the protection of the rights of rehabilitation service users.
Discussions were held with the management and staff of the center regarding the legal basis of its activities, documentation, nutrition, rehabilitation programs applied, treatment issues, and the right to appeal.
In the course of the monitoring , the dining areas, prayer rooms, administrative sections, and recreation zones of boarding facility were inspected, and several individuals undergoing rehabilitation were interviewed on a voluntary basis and in a confidential manner.
The issues related to respecting the privacy and personal life of rehabilitation service users were examined, and it was emphasized that information about these persons may only be made public with their voluntary consent.
In the course of the monitoring, it was emphasized the importance of the presence of information boards on the activities of the Ombudsman’s ‘916’ Call Center, and ensuring the implementation of the rights of rehabilitation service users to submit complaints to the Ombudsman.
The legal education tools produced by the Ombudsman Office were presented to the representatives of the center.
It should be noted that it is necessary to ensure regular oversight of rehabilitation service centers, advance the relevant legal framework and licensing processes, and strict adherence to ethical principles. In addition, it is particularly important that media representatives and the public respect the privacy of rehabilitation users. Furthermore, it should be emphasized that the dissemination of unverified information about such centers, which are crucial for the social reintegration of persons suffering from addictions, raises concerns.
The Ombudsman takes this matter under her control. The monitoring of rehabilitation centers will be continued, and based on the findings, the analysis will be made and the relevant recommendations and suggestions will be prepared to submit to the competent state authorities.
